whathotel.io Terms and Conditions
Version: v1
Last updated: 27 February 2026
1. About these Terms
These Terms and Conditions apply to your use of whathotel.io and any related pages, features, and services we make available.
By using the service, you agree to these Terms. If you do not agree, do not use the service.
2. Who we are
whathotel.io is operated by What Gift Ltd. We are a company registered in England and Wales under company number 15436340.
Registered address: 71 to 75 Shelton Street, London WC2H 9JQ, United Kingdom.
Contact: admin@what.gift
3. What the service is
whathotel.io provides a directory and tools to help users discover and compare hotels, including information that may relate to loyalty benefits and user contributed reviews and reports.
WhatHotel is independent and not affiliated with or endorsed by Marriott International. All trademarks are the property of their respective owners.
4. Eligibility
You may use the service only if you can form a legally binding contract where you live.
You must be 18 or over to create an account.
5. Accounts
Some features may require an account.
You are responsible for activity on your account and for keeping access methods secure.
If you sign in using a third party provider such as Google or Apple, that provider is a separate service and its terms and security apply. We are not responsible for issues caused by the provider or your account with them.
We may suspend or terminate accounts that breach these Terms.
6. User content
6.1 Your responsibility
You are responsible for content you submit, such as reviews, tips, or reports.
You confirm that you have the rights needed to submit your content and that it does not infringe the rights of others.
You must not submit content that is unlawful, defamatory, misleading, or that breaches any privacy or publicity rights.
6.2 Licence you give us
You grant us a worldwide, non exclusive, royalty free licence to host, store, reproduce, display, and make your content available to others for the purposes of operating, improving, and promoting the service.
This licence continues while your content remains on the service, even if your account is closed, unless you delete the content or we remove it.
6.3 Moderation and our role
We act as an intermediary and host user content.
We do not create user content and user content is the responsibility of the user who submitted it.
We may remove or restrict access to content at any time, for example where we believe it breaches these Terms, is unlawful, or may cause harm.
We may apply technical formatting for display, for example layout, truncation, or ordering, without changing the meaning.
6.4 Community standards
You must not submit content that:
- includes threats of violence, encouragement of violence, or credible intent to harm people or property, even if framed as sarcasm, jokes, or exaggeration
- promotes hatred or discrimination based on protected characteristics
- harasses, intimidates, or targets individuals
- promotes or describes participation in illegal activity in a way that encourages or glorifies it
- promotes participation in sexual services or non prescription drug use
- contains confidential or sensitive information, including access codes, Wi Fi passwords, door codes, payment details, private contact details, or private guest information shared by others
- includes surnames or identifying details of private individuals, except where clearly relevant to a public professional role. For example, business owners, senior managers, executives, or public professionals
- is substantially political, religious, or otherwise off topic for travel and hotel experiences. However, users may describe and criticise discriminatory treatment or practices as part of a hotel or travel experience
- is spam, advertising, self promotion, or includes affiliate or referral codes, including links to personal blogs or social profiles that are promotional or irrelevant
- is plagiarised, AI generated, heavily copied or quoted from other sources, impersonates others, or is generated in bulk for manipulation
- uses formatting intended to spam or disrupt, including excessive all caps, repeated symbols, embedded HTML, or excessive profanity
Keep it clean. If you would not say it out loud in public, do not post it here. Use plain, factual language and avoid vulgar or graphic descriptions unless needed to convey important safety information.
Because this is a global service, we may remove terms or content that is extremely offensive in any geography, even if it may be acceptable elsewhere.
We may allow eye witness accounts of serious incidents, including crimes or non consensual activity, where shared to inform travellers about safety. Content that encourages, celebrates, or promotes harm is not allowed.
We may remove content for quality and safety reasons, including where machine translated text is hard to understand or changes the intended meaning.
Where appropriate, we may report serious threats or suspected illegal activity to relevant authorities.
7. Acceptable use
You must not use the service in a way that is unlawful, harmful, abusive, misleading, or that interferes with the service.
You must not attempt to access, copy, or scrape the service using automated means, except where we explicitly permit it.
You must not attempt to bypass security, rate limits, or access controls.
8. Intellectual property
We own or license the service, including text, layout, design, logos, and software, except for user content.
You may use the service for personal and lawful purposes only.
All third party trademarks and brand names are the property of their respective owners.
9. Third party links and services
The service may link to third party sites, including booking and hotel websites.
We do not control third party sites and are not responsible for their content, availability, or policies. Your dealings with third parties are between you and them.
10. Ads and affiliate links
The service may display advertising.
Some outbound links may be affiliate links, meaning we may earn a commission if you take an action after clicking. This does not change the price you pay unless the third party states otherwise.
11. Disclaimers
11.1 Information is provided as is
The service is provided on an as is and as available basis.
Hotel information, benefits, amenities, lounge access, upgrades, breakfast, and similar details may be incomplete, inaccurate, or out of date.
You use the service at your own risk and you are responsible for decisions you make based on the information.
11.2 No guarantee of loyalty benefits
Any statements about loyalty benefits, upgrades, credits, or entitlements are informational only and are subject to availability and the rules of the relevant program. Benefits are not guaranteed.
11.3 Reviews and user content
Reviews, ratings, and any user submitted text or images are unverified and reflect the personal, subjective opinions and experiences of users. They are not statements of fact endorsed by us.
We do not verify stays unless we explicitly say we do.
11.4 Not a booking agent
We do not sell travel services and we are not a booking agent or tour operator. Any bookings you make are with third parties.
12. Notice and takedown
If you believe content on the service is unlawful, defamatory, or infringes your rights, please email admin@what.gift.
We may disclose information about a user if required by law or a court order, or where needed to protect our legal rights.
To help us act quickly, include:
- the URL where the content appears
- what you believe is unlawful, defamatory, or infringing and why
- the meaning you believe the statement conveys, if relevant
- which parts you believe are factually inaccurate or are opinions not supported by fact, if relevant
- your full name, address, and a contact email address
- confirmation that you are acting in good faith
For copyright complaints, also include:
- a description of the copyrighted work
- identification of the material you believe is infringing and where it appears
- confirmation that you are the rights holder or authorised to act for them
We may ask for further information if a notice is incomplete.
We may remove or restrict access to content while we review a complaint.
13. Limitation of liability
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
To the maximum extent permitted by law, we exclude all implied terms, guarantees, and warranties.
To the maximum extent permitted by law, we are not liable for any loss of profits, loss of revenue, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss.
Subject to the above, our total liability to you for all claims arising out of or relating to the service is limited to GBP 100.
13.1 User responsibility for losses
If you intentionally or recklessly breach these Terms or the law, and that causes us foreseeable losses, costs, or claims, you are responsible for those losses to the extent permitted by law.
This does not affect your statutory rights and it does not apply where you are not at fault.
14. Indemnification
If you submit content or use the service in a way that intentionally or recklessly breaches these Terms or the law, and this leads to a claim or demand against us by a third party, you agree to indemnify us for the reasonable losses and costs we suffer that are directly caused by your breach, including reasonable legal fees, to the extent permitted by law.
We may take control of the defence and settlement of any claim, and you agree to cooperate.
This clause does not apply where you are not at fault.
15. Changes to the service and Terms
We may change the service at any time, including adding or removing features.
We may update these Terms from time to time. The updated version will apply from the date shown at the top.
16. Complaints and disputes
If you have a complaint, please contact us and we will try to resolve it.
17. Governing law and courts
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may have the benefit of mandatory consumer protections under the laws of your country of residence.
The courts of England and Wales will have jurisdiction over disputes, subject to any mandatory rights you may have to bring claims in the courts of your country of residence.
17.1 US class action waiver
If you are a resident of the United States, to the extent permitted by law, you agree to bring any claim only in your individual capacity and not as a plaintiff or class member in any class, collective, representative, or private attorney general action.
If this clause is found unenforceable, it will not affect the enforceability of the rest of these Terms.
18. Severability
If any part of these Terms is found unlawful or unenforceable, the remaining parts remain in effect.
If a provision is found unlawful or unenforceable, it will be limited or replaced to the minimum extent necessary so that it becomes lawful and enforceable, while reflecting the original intent as closely as possible.
19. Other policies
Our Privacy Policy and Cookie Policy explain how we handle personal data and cookies.
